MANJARI NEHRU KAUL, J. (Oral) The present petition has been filed for directing respondents No.2 and 3 for taking action on the representation (Annexure P7) of the petitioner .

Contends that respondent No.5 is a habitual offender having duped a number of innocent persons by luring them to part with huge sums of money for procuring a visa for them. Learned counsel further contends that the petitioner was duped of Rs.8,50,000/- and given an offer letter of a college of Canada which was found to be fake. It has been submitted that the factum of respondent No.5 being involved in the crime in question is evident from the fact that on a demand being made by the petitioner of returning the amount so paid to her, she issued a cheque of Rs.8,50,000/- to the petitioner which however was dishonored leading to a complaint under Section 138 of the Negotiable Instruments Act being filed against her. CRM-M-5052-2021 [ 2 ] complaint under Section 138 of the Negotiable Instruments Act the respondent No.5 compromised the matter and entered into an agreement with the petitioner to pay back the amount taken by her but backtracked soon thereafter leaving the petitioner in a lurch because of her links with the local police. It has been submitted by the learned counsel that despite repeated complaints having been made to the DSP, Baba Bakala Sahib, Amritsar, against respondent No.5, no action was taken by the authorities concerned and thus they were left with no other option but to approach the Senior Superintendent of Police, Amritsar (Rural) vide representation dated 21.01.2021 (Annexure P7) wherein also the petitioner made a mention of the complaint having been made to the DSP, Baba Bakala Sahib, Amritsar. Learned counsel submits that the petitioner would be satisfied if a direction is issued to respondent No.2 for taking a decision on his representation dated 21.01.2021 (Annexure P7).

Notice of motion.

On the asking of the Court, Mr. Luvinder Sofar, AAG, Punjab, accepts notice on behalf of the State.

In view of the above, this petition is disposed of with a direction to respondent No.2 i.e. Senior Superintendent of Police, Amritsar (Rural) to look into the representation dated 21.01.2021 (Annexure P7) of the petitioner and take appropriate action, if required, in accordance with law at the earliest.
