The petitioner wishes to produce a deed of cancellation of the Will in additional evidence. Admittedly, a photocopy of the aforesaid deed of cancellation has already been exhibited in the Court. Its attesting witness, namely Sh.Kulwant Singh, has already been examined by the petitioner. Now, the petitioner only wishes to tender into evidence the original deed of cancellation. Hence, the trial Court has erred in refusing to tender the primary evidence.

The learned counsel representing the respondent No.1 to 3 (defendants) contends that the plaintiff is intentionally delaying the disposal of the suit for the last 11 years. The parties have led their evidence. 3.

Keeping in view the aforesaid facts, the order under challenge DEEPAK KUMAR BHARDWAJ 2022.09.16 10:36 I attest to the accuracy and integrity of this document is set aside while allowing the revision petition. Let the petitioner tender

Civil Revision No. 6245 of 2018 the original deed of cancellation in his evidence. The trial Court is directed to dispose of the suit expeditiously, preferably within a period of three months, from today.
