Petitioner (Ranjit Kaur) has filed the instant Writ Petition under Articles 226/227 of the Constitution of India seeking a writ in the nature of mandamus for directing the respondents to re-fix the family pension of the petitioner in view of the revision of pay scale for the post of Gangman with the department w.e.f. 01.01.2006 as per the notification dated 27.05.2009 (Annexure P-2) whereby the new rule i.e. The Punjab Civil Services (Revised Pay) Rules, 2009 were made applicable w.e.f. 01.01.2006 and also to pay the arrears of revised family pension, Gratuity, Leave encashment and Ex-gratia Grant along with 12% interest.

A further prayer has been made by the petitioner for directing the respondents to decide and consider the representations dated 11.07.2023

At the outset, learned counsel for the petitioner submits that as regards the relief claimed in the present writ petition, the petitioner has also submitted representations dated 11.07.2023 (Annexure P-4) and 22.09.2023 (Annexure P-5) upon the respondents; however, the same have not been decided till date. It is submitted that the petitioner would be satisfied at this stage, if a direction is issued to the respondent No.2 to consider/decide the afore-said representations dated 11.07.2023 (Annexure P-4) and 22.09.2023 (Annexure P-5), in a time bound manner.

At this stage, learned State counsel-Mr. Sanjeev Soni, Additional Advocate General, Punjab, appears and submits that in case, the aforesaid representations dated 11.07.2023 (Annexure P-4) and 22.09.2023 (Annexure P-5) have been submitted and received in the concerned Office, then the same shall be looked into/decided in accordance with law by the concerned authority and an appropriate speaking order will be passed. 5.

Since the petitioner claims to have submitted representations dated 11.07.2023 (Annexure P-4) and 22.09.2023 (Annexure P-5) upon the concerned authorities, especially respondent No.2 in the present petition; accordingly, without commenting anything on the merits of the case, I deem it appropriate to dispose of the instant writ petition by directing respondent No.2 i.e. Director, Health and Family Welfare, Punjab Parivar Kalyan Bhawan, Chandigarh, to look into, consider and decide the aforesaid representations dated 11.07.2023 (Annexure P-4) and 22.09.2023 (Annexure P-5) by passing a speaking order within a period of six weeks from today. It goes without saying that in case, the petitioner is entitled to any relief, the

-3same may be granted to her in accordance with law. 6.

Disposed of in the afore-said terms.
