CHANDIGARH CR-6700-2015(O&M) Date of decision: 09.08.2022 JASWINDER KAUR ..Petitioner

Versus

GURJIT SINGH AND ORS ..Respondent CORAM: HON'BLE MR. JUSTICE ANIL KSHETARPAL

Present:

Mr. S.P. Arora, Advocate for the petitioner.

Mr. Vijay Lath, Advocate for respondent No.1.

ANIL KSHETARPAL, J(Oral) The judgment debtor assails the correctness of order passed by the Executing Court dated 07.09.2015, while dismissing his objection petition. On the basis of a mutual settlement, a decree was passed by the Court. The decree holder filed a execution petition. In the aforesaid execution petition, the judgment debtor filed objections claiming that there was a subsequent compromise between the parties which superseded the previous one. A separate suit filed by the decree holder for declaration challenging the subsequent compromise has been decreed. Hence, the entire basis of the objections ceases to exist. No ground to interfere is made out.

Dismissed.

All the pending miscellaneous applications, if any, are also disposed of.
