R.P. Nagrath, J. (Oral) The petitioner has invoked the jurisdiction of this Court under Article 227 of the Constitution of India, seeking to set aside the orders dated 31.05.2013 (Annexure P-4), 30.07.2013 (Annexure P-5) and 06.09.2013 (Annexure P-6), passed by the trial Court.

Learned counsel for the respondent submits that respondent-decree holder is not getting actual possession of the land on the basis of warrants of possession issued by the Executing Court, though, the contention raised is that the possession was taken in a compromise. However, the appeal is still pending against the judgment and decree.

After arguing for sometime, learned counsel for the petitioners submits that the instant petition may be disposed of with a direction to the Appellate Court to dispose of the main appeal expeditiously.
