**** RAJ MOHAN SINGH, J. (Oral) The case has been taken up for hearing through video conferencing.

Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.2 dated 09.01.2018 registered under Section 379-B IPC (Sections 379, 411 and 479 IPC added subsequently) at Police Station Purana Shalla, District Gurdaspur.

Notice of motion was issued on 27.01.2020 on the premise that regular bail was granted to the petitioner by the Additional Sessions Judge Gurdaspur, vide order dated 06.02.2018. On 16.12.2019, the case was adjourned to 15.01.2020 for prosecution evidence but due to wrong recording of date as 16.01.2020, the petitioner could not appear before the Court nor could his counsel appeared due to that wrong recording of date. Bail of the petitioner was cancelled. Bail bonds and surety bonds were forfeited to the State and non-

bailable warrants were issued against the petitioner. Vide the aforesaid order dated 27.01.2020, petitioner was directed to appear before the trial Court on the date fixed and in the event of his appearance he was to be granted interim bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial Court.

Today, learned counsel for the petitioner has placed on record photocopy of order dated 14.02.2020 passed by Additional Sessions Judge Gurdaspur, admitting the petitioner on bail in compliance of the order dated 27.01.2020 passed by this court. Though the petitioner was directed to appear before the trial Court on 05.02.2020 but the Court was on leave on that day and the case was adjourned to 14.02.2020 and i.e. how the trial Court passed the order dated 14.02.2020, admitting the petitioner on bail in compliance of order dated 27.01.2020 passed by this Court.
