Civil Revision No.6700 of 2016 (O&M) -1IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH Civil Revision No.6700 of 2016 (O&M) Date of Order: 22.09.2017 Surat Singh (since deceased) through LRs ..Petitioners

Versus

Beant Singh and others ..Respondents CORAM: HON'BLE MR. JUSTICE ANIL KSHETARPAL

Present:

Mr. G.S.Virk, Advocate, for Mr. G.S.Nagra, Advocate, for the petitioners.

ANIL KSHETARPAL, J (Oral) Judgment debtors are in revision petition against order passed by learned Civil Judge (Jr. Division), Ajnala, dated 16.02.2016. Decree holder-Beant Singh had died and Najinder Pal Singh moved an application for bringing on record legal heirs of Beant Singh on the basis of a registered will dated 21.05.2010. Judgment debtors objected to the same. However, objections to the application for bringing on record the legal heirs have been rejected. Learned Court has held that judgment debtors have nothing to do with any dispute inter-se between the legal heirs of the decree holder. They are not the legal heirs of decree holder. During the course of arguments, learned counsel for the petitioners have brought to my notice that the children of Beant Singh have moved another application for bringing on record the legal heirs. That application was also dismissed but a revision is pending. In view of the fact that natural heirs are already prosecuting, Naresh Kumar 2017.10.06 13:51 I attest to the accuracy and integrity of this document Chandigarh

Civil Revision No.6700 of 2016 (O&M) -2judgment debtors does not have any locus standi to object to the execution of the decree.

In view of what has been recorded hereinabove, I do not find any good ground to interfere with the impugned order. The revision petition is dismissed.
