An unstamped agreement is in the nature of a document which is insufficiently stamped and the Court has orderd the impounding of the document. The objection taken now before this Court is that only insufficiently stamped document can be impounded and if it is on the plain paper, it can not be impounded. It is clear misunderstanding of the provision of law, for agreement on plain paper must be treated as an agreement written on insufficiently stamped document and therefore, in PANKAJ KUMAR 2016.01.21 12:14 I attest to the accuracy and integrity of this document
C.R. No.6730 of 2015 (O&M) -2order to validate the same in the manner required under Section 35 of the Stamp Act, stamp duty penalty is liable to be paid. The Court has done what is appropriate and just.
