Mr. R.K Chaudhary, Advocate for the petitioner. HARSIMRAN SINGH SETHI, J (ORAL) In the present writ petition, the prayer is for release of the pensionary benefits for which the petitioner became entitled after his retirement on 31.12.2017.

Learned counsel for the petitioner states that even though there is no impediment in releasing the retiral benefits but the same are being withheld by the respondents without any valid justification. He states that the gratuity, arrears of 7th Pay Commission and leave encashment have not been released to the petitioner.

Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has served respondents with a legal notice dated 22.10.2018 (Annexure P-13), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

CWP No.2041 of 2019 #2# the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 22.10.2018 (Annexure P-13) by passing a speaking order within a period of two months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to her within a period of next two months. Present writ petition stands disposed of.
