CORAM : HON'BLE MS. JUSTICE RITU BAHRI Present :

Ms. Ekta Thakur, Advocate for the petitioners.

*** RITU BAHRI, J. (Oral) Petitioner has come up in revision filed under Article 227 of the Constitution of India for setting aside order dated 05.09.2017 passed by learned Motor Accidents Claim Tribunal, Chandigarh whereby application under Order 6 Rule 17 CPC for correction of the name of respondent No. 1 has been allowed, however, a cost of Rs.1000/- has been imposed upon the petitioners. Learned counsel contends that since the amendment sought by the petitioners is merely a correction in the name of respondent No. 1, the learned Tribunal has erred in law in imposing cost of Rs.1000/- upon the petitioners. In view of the above factual position, the petition is partly allowed and the impugned order dated 05.09.2017 is modified to the extent that the petitioners will not make the payment of cost of Rs.1000/- imposed by the Tribunal.
