(Oral) After arguing for some time, learned counsel for the petitioner seeks permission of this Court for withdrawal of the present revision petition with liberty to avail remedy, as per Order 21 Rule 97 or Rule 99 CPC as the application under Order 1 Rule 10 CPC, in execution application, ex facie, is not maintainable. In view of the aforesaid statement made by learned counsel for the petitioner, the present revision petition is ordered to be dismissed as withdrawn with liberty as prayed for. It is made clear that filing of the objections would not entitle the trial Court to entertain the objections as independent suit until and unless the petitioner satisfies the Court, vis-a-vis, her possession.
