(ORAL) [1] Status report by way of affidavit dated 22.02.2024 of Shri Arun Mundan, PPS, Deputy Superintendent of Police, Sub Division Abohar, District Fazilka, on behalf of the respondent-State has been filed in Court today. The same is taken on record. Copy thereof has been supplied to learned counsel opposite.
[2] On 29.01.2024, the following order was passed by this Court:- " Present:
Mr. Ashok Kumar Khunger, Advocate for the petitioner. **** By way of present petition filed under Section 438 Cr.P.C., prayer is made for grant of pre-arrest bail in case FIR No.0089 dated 20.08.2023, under Sections 341, 379-B, 34 of IPC, registered at Police Station City-2 Abohar, District Fazilka.
Allegations are that petitioner along with co-accused snatched an amount of ₹ 10,000/- and mobile phone from complainant Vishal on 20.08.2023 at about 10 O'clock.
It is contended by learned counsel for the petitioner that the petitioner has been falsely implicated and that with the intervention of Panchayat and respectable persons, matter has since been compromised amongst the parties. Learned counsel points out that the said fact regarding the compromise has already been noticed by learned Sessions RAJNEESH SHARMA 2024.02.22 06:03 I attest to the accuracy and integrity of this document

Learned counsel also contends that in the similar circumstances, co-accused Gobind @ Govind has already been given the benefit of interim anticipatory bail by this Court vide order dated 11.12.2023 passed in CRM-M-62042-2023. Notice of motion.
Mr. Anmol Singh Sandhu, AAG, Punjab accepts notice on behalf of the respondent-State. A copy of paper book be supplied to him during the course of day.
Adjourned to 22.02.2024 for filing status report. To be heard alongwith CRM-M-62042-2023.
In the meantime, petitioner is directed to join investigation and cooperate in the same. He will not leave the country without prior permission of the Court nor shall make any attempt to contact the complainant of the case or any witness associated with the case. In the event of the arrest of the petitioner, he shall be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 438(2) Cr.P.C. "
[3] Today, learned State Counsel, on instructions from ASI Balwinder Singh, has informed this Court that the petitioner has joined the investigation, in compliance of the order dated 29.01.2024 and is no longer required for further investigation. [4] In view of the aforesaid, the order dated 29.01.2024, whereby the petitioner was granted interim anticipatory bail, is hereby made absolute. However, he shall continue to join investigation, if and so required by the Investigating Officer.
