ANIL KSHETARPAL, J(Oral) Defendant-petitioner is in revision petition against the order passed by the learned trial court, dismissing application under Section 45 of the Indian Evidence Act, 1872, seeking permission of the Court to get the signatures of the defendants examined on writing dated 30.03.2005 and 29.06.2005 from a Handwriting and Finger Print Expert. The suit is for specific performance of the agreement to sell. Learned trial court has noticed that the defendant-petitioner has been granted 8 effective opportunities to lead evidence, however, the defendant failed to conclude his evidence.

Now when the case is at the rebuttal stage, the present application has been moved. The trial court has formed an opinion that the application was filed solely to delay the proceedings in the case. The court has noticed that the case is very old.

Civil Revision No.6835 of 2016 (O&M) -2Taking into consideration the observations made by the learned trial court, this court does not find any good ground to interfere with the impugned order passed.
