The present petition has been filed seeking quashing of impugned order dated 18.12.2019 passed by JMIC Amloh whereby the application for summoning of the complainant witness in the Court has wrongly been dismissed during the course of evidence in a criminal complaint filed under Sections 323, 324, 325, 452, 447, 506, 148, 34 IPC, 1860 against the respondent. 2.

At the outset, learned counsel for the petitioner seeks to withdraw the present petition as the same has been rendered infructuous. 3.

The prayer so made is allowed.
