-.- AMIT RAWAL J.(ORAL) The revision petition has been preferred against the dismissal of the application moved under Section 5 of the Limitation Act for condonation of delay filed in the objection petition moved under Section 34 of the Arbitration and Conciliation Act, 1996. Section 5 of the Limitation Act does not apply to the provisions of Section 34, in view of the plain and simple language and also according to Section 29(2) of the Limitation Act. Even if some application was moved, there is remedy of appeal under Section 37 of the 1996 Act. The revision petition is not maintainable. Faced with the situation, learned counsel appearing for the petitioners seeks liberty of this Court for withdrawal of the revision petition to avail the remedy of appeal. The revision petition is dismissed as withdrawn but with liberty as aforesaid.
