(ORAL) The present revision petition is directed against the order of the lower Appellate Court dated 17.07.2017 (Annexure P-6) whereby misc. appeal of the respondents-plaintiffs against the order of the trial Court rejecting the application under Order 39 Rule 1 and 2 CPC in suit for permanent injunction has been allowed and the petitioner-defendant had been restrained from shifting gate of Harijan chopal. The trial Court had though declined the application but the lower Appellate Court, as noticed above, has allowed the same. The plaint annexed with the revision petition as Annexure P-1 is dated 16.02.2015. Respondents have already been proceeded ex parte in the present revision petition. Almost two years have gone by but the suit must have been pending. Instead of pondering upon merit of the revision petition, I deem it appropriate to dispose of the revision petition with direction to the trial Court to decide the civil suit within a PANKAJ KUMAR 2019.05.20 14:13 I attest to the accuracy and integrity of this document
