(ORAL) Counsel for the petitioner states that the petitioner was charge-sheeted on 16.04.2015 on the allegation of causing loss to the respondents/Federation, amounting to `4,51,512/- by giving less gain. Counsel for the petitioner further states that despite the show-cause notice issued in this regard after the inquiry report was submitted, no further order has been passed by the respondents in respect to the said charge-sheet even upto now.
The contention has been raised that on one hand the inquiry proceedings are being kept pending and on the other hand the retiral benefits for which the petitioner is entitled for, are being withheld on the account of the pendency of the said chargesheet. Counsel for the petitioner further states that only part payment has been released and now there is no valid justification with the respondents to withhold the benefits for which petitioner is entitled. CWP-2118-2019 -2Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has served respondents with a legal notice on 08.03.2018 (Annexure P-7), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 08.03.2018 (Annexure P-7) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.
Present writ petition stands disposed of.
