(ORAL) This is a petition filed under Article 227 of the Constitution of India seeking issuance of directions to the Civil Judge (Junior Division)/Rent Controller, Ludhiana, to decide the Rent Petition No.RP/821/2015, titled as 'Gurinder Singh Vs. Ravinder Rai Sapra and another', in a time bound manner.

A perusal of the record shows that the petitioner-landlord had filed the eviction petition way back in the year 2015. The evidence of the petitioner stood closed vide order dated 06.09.2018. Thereafter, even the evidence of the respondents-tenants stood closed vide order dated 16.05.2019. Even thereafter, the respondents-tenants have been moving one application after the other, including the applications for adjournments and amendment of the pleadings. The last application for amendment of the pleadings was also dismissed on 11.10.2022. CR-548-2023 -2of the eviction petition. This is nothing but abject misuse of the process of the Court, which deserves to be prevented with immediate effect by passing some coercive directions.

Accordingly, the present petition is disposed of with a direction to the Rent Controller, Ludhiana, to decide the rent petition within a period of three months from today. No unnecessary application on behalf of the respondents-tenants shall be entertained. Even if any application is so filed, that has also to be decided within the above-said period of three months; and in case the said application is found to worth dismissal, the same shall be dismissed by the Rent Controller with a costs of Rs.50,000/-, which is being hereby determined by this Court.

Disposed of in aforesaid terms.
