Present petition under Article 227 of the Constitution of India for setting aside order dated 17.3.2012, whereby application under Section 34 of the Arbitration & Conciliation Act, 1996 of the petitioner was dismissed being time barred.
Learned counsel for the petitioner mainly submitted that copy of the award was not sent to the petitioner as he was not a party to the arbitration proceedings. The case of petitioner is squarely covered as per order passed by this Court in Hazara Singh v. Union of India and Others (Civil Revision No. 3996 of 2012, decided DEEPAK KUMAR BHARDWAJ 2016.01.18 12:07 I attest to the accuracy and integrity of this document

Learned counsel for respondents No.1 & 2 has failed to lay his hands on any such document to show that copy of award was infact sent to the petitioner.
The situation being so, a copy of award was not sent to the petitioner as per plea taken by learned counsel for the petitioner. The present petition is accepted and order dated 17.3.2012 stands set aside. Parties are directed to appear before the trial Court on 8.2.2016 and the trial Court shall proceed further to dispose of the matter in accordance with law.
