The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to re-issue him passport.

The petitioner was issued passport on 23.04.2007 which expired on 22.04.2017. As per petitioner, he lost his expired passport on 13.08.2023. The petitioner applied for re-issuance of passport on 26.08.2023. The petitioner was involved in three FIRs. The petitioner vide judgment dated 01.05.2014 passed by this Court in CRA-S-1542-SB of 2003 was acquitted in FIR No. 93 of 2002. The petitioner was convicted in FIR No. 94 of 2002 and he was awarded sentence of rigorous imprisonment of six months with fine of Rs. 1000/-. CWP No.1948 of 2024 -2- 2024:PHHC:033932 months and paid fine. This Court vide order dated 04.03.2009 passed in CRM-M- 1570 of 2008 has quashed FIR No. 178 of 28.07.2007. 3.

Mr. Ashutosh Dhankar, Advocate, submits that petitioner may be directed to appear before the passport authority alongwith requisite documents. Thereafter, the passport authority would pass an appropriate order within six weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed of with a direction to petitioner to appear before the passport authority on 02.04.2024 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order within six weeks from 02.04.2024.
