Through the instant writ petition, a prayer has been made for issuance of directions to the respondent No.1 to allow the members/workers of the petitioner-Union to utilize their provident fund deposits, as, on account of pending enquiry against the respondent No.2contractor, the respondent No.1 has been rejecting their EPF withdrawal claims.

Learned counsel for the respondent No.1 has informed this Court that proceedings under Section 7-A of the Employees9 Provident Funds and Misc. Provisions Act, 1952, have already been initiated against the respondent No.2, and an apt decision will be taken in accordance with law.

Learned counsel for the petitioner has also informed this DEVINDER YADAV 2026.01.08 16:59 I attest to the accuracy and authenticity of this order/judgment

CWP-2125-2022 Court that, during the pendency of the instant writ petition, the members/workers of the petitioner-Union have been allowed to operate their EPF accounts, hence the prayer enclosed in the instant writ petition has become infructuous.

In view of the submissions made by learned counsel for the parties, the instant writ petition is closed at this stage. However, liberty is reserved to the petitioner-Union to, in case, its grievance still survives, approach the competent authority concerned.

Disposed of accordingly.
