The learned counsel representing the petitioner admits that in view of the order dated 01.02.2023, the writ petition is rendered infrucutuous. The aforesaid order reads as under:- "On 04.02.2022, the following order was passed while issuing the notice of motion:- "Inter alia contends that in view of Clause 10 of the Model Code of Conduct dated 08.01.2022 (P-2), petitioner cannot join at the transferred place of posting. Notice of motion for 06.04.2022.
Notice regarding interim relief as well. Till the next date of hearing, operation of impugned order dated 06.01.2022 (P-4) shall remain stayed."

Civil Writ Petition No. 2090 of 2022 submits that now the Clause 10 of the Model Code of Conduct is no longer in force, hence, the writ petition is required to be dismissed.
The learned counsel representing the petitioner is not present.
List on 03.02.2023, in the urgent list after notifying the learned counsel representing the petitioner." 2 .
However, the learned counsel representing the petitioner submits that the petitioner, on attaining the age of superannuation, will be retiring in the month of October, 2023. He prays for permission to withdraw the present writ petition in order to make a representation to the competent authority.
