(ORAL) Petitioner - Lakhmi Chand alias Laxmi Chand son of late Chhaju Ram, by filing the present petition, seeks issuance of a writ in the nature of certiorari for quashing the impugned order dated 21.09.2020 (Annexre P-3) passed by the District Revenue Officer and Consolidation Officer, Palwal, Haryana (respondent No. 3), which had been passed in the absence of the petitioner and private respondent Nos. 5 & 6 [ (5) Satpal Singh; and (6) Rampal Singh, both sons of Sehju Ram ], allegedly given the benefit to private respondents; further the said order also in violation of the judgement dated 04.09.2015 (Annexure P-2) passed by this Court in CWP No.
10671 of 1993, titled "Chhaju Ram (since deceased) through LRs Versus Director Consolidation, Haryana and others", wherein it was directed that Consolidation Officer would decide the appeal of Sehju (since deceased), father of the aforesaid private respondent Nos. 5 & 6, within three months from the receipt of the copy of order dated 04.09.2015 (P-2). No. 4523 of 2021 (O&M) -2After arguing for some time, counsel for the petitioner realizing that the alternative remedy of filing a revision under Section 42 of the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948 is available, prays for permission to withdraw the present petition to avail the remedies in accordance with law.
