This criminal miscellaneous petition has been filed by the petitioner under Section 482 Cr.P.C. for directing the official respondents No.1 and 2 for protection of life and liberty of his father and his family members from the hands of the erring official respondent No.3, who is threatening to the petitioner and his family members. He has further prayed for directing the official respondents to conduct the medical tests under the Board of PGI, Chandigarh because respondent No.3 has given third degree torture to his father due to which he is severely injured and was admitted in PGI, Chandigarh. He has further prayed for necessary direction to respondents No.1 and 2 to put the status report of the medical condition of the petitioner's father. He has further prayed to find out the truth and justice for the petitioner and that a fair inquiry should be conducted and to take legal action against the erring officials and further prayed that the

Cr. Misc. No.M-3412 of 2019 [2] investigation of the present FIR may be conducted under the supervision not below the rank of Superintendent of Police.

Status report by way of affidavit of Mr. Satpal Sharma, PPS, Deputy Superintendent of Police, Sub Division, Sangrur, filed on behalf of respondents No.1 to 3 in compliance with the order dated 25.2.2019 passed by this Court has already been taken on record. Heard learned counsel for the petitioner and learned State counsel.

A perusal of the reply filed by way of affidavit by Deputy Superintendent of Police, Sub Division, Sangrur, reveals that it has been specifically mentioned therein that the present petitioner had submitted representation dated 17.01.2019 (Annexure-P.3) with the allegations that the local Police of Police Station, Sadar, Sangrur, gave beatings to his father Narsi Singh. The said representation was received in the office of S.S.P., Sangrur and was entrusted to DSP, Sub Division, Sangrur for conducting inquiry. During inquiry, petitioner-Manjit Singh got recorded his statement that he had submitted above said application on instigation by somebody as well as under some misunderstanding, but now his misunderstanding has been removed and he does not want to pursue his application further.

So, the allegations of giving beatings to the father of the petitioner by the Police of Police Station Sadar, Sangrur, are false and baseless. Learned State counsel states that father of the petitioner has since died in custody and judicial inquiry is being conducted under the supervision of Illaqa Magistrate.

Cr. Misc. No.M-3412 of 2019 [3] In view of the above, the present petition has become infructuous and the same is disposed of as such. January 30, 2020.
