The trial Court, after noticing that the plaintiff while filing the suit has claimed recovery of a definite amount of ₹37,04,000/- has directed the plaintiff to pay the ad valorem court fee. 2.

Heard the learned counsel representing the parties, at length and with their able assistance, perused the paper-book. 3.

The learned counsel representing the petitioner contends that the suit is primarily, in the nature of rendition of accounts, therefore, the ad valorem court fee of ₹ 37,04,000/- could not have been directed. 4.

On reading of para 15 and 16 of the plaint, it is evident that the plaintiff claims the recovery of ₹37,04,000/-. In the plaint, the plaintiff prays for decree of mandatory injunction directing the defendants to make payment of damages/loss caused to the defendant. In essence, the aforesaid DEEPAK KUMAR BHARDWAJ 2022.10.10 11:09 I attest to the accuracy and integrity of this document suit is for recovery of a definite amount.

Civil Revision No. 6666 of 2017 (O&M) 5.

In view of the recent judgment in State of Punjab and Others v. Dev Brat Sharma 2022 SCConline SC 330, no ground to interfere is made out. Hence, the present revision petition is dismissed. 6.

The miscellaneous application(s) pending, if any, shall stand disposed of.
