(ORAL) This is a petition filed by the petitioner/defendant under Section 15(5) of the East Punjab Rent Restriction Act, 1949, for setting aside the impugned order dated 20.01.2023 passed by the Appellate Court, whereby application for grant of interim temporary injunction has been dismissed. A perusal of the order impugned in the present petition shows that the petitioner, who is the tenant of the premises of the respondent, is not even paying the rent as such. Moreover, the Rent Controller, Hoshiarpur, has already passed the eviction order against the present petitioner. Therefore, this Court does not find any ground to interfere with the order impugned in the present petition. Therefore, the present petition is dismissed.

However, a perusal of the paper-book shows that the appeal filed by the present petitioner before the Appellate Authority is pending since the year 2019. Therefore, the Appellate Authority is directed to decide the main appeal itself within a period of two months from the date of receipt of certified copy of this order.
