(Oral) After arguing for sometime, learned counsel for the petitioner has made a prayer that the instant petition may be disposed of with a direction to the trial Court to decide the suit in a time bound frame as the petitioner is a senior citizen. If that be so, the instant petition is disposed of with a direction to the trial Court to dispose of the suit within one year and the plaintiff-respondents would close their evidence within four months from the date already fixed by the trial Court and thereafter defendant-petitioner and respondents no. 4 to 6 would close their evidence within next four months.

Learned State counsel, however, submits that as per his instructions the written statement by respondents no. 4 to 6, who are defendants no. 2 to 4, has not been filed whereas learned petitioner's JITENDER KUMAR 2015.01.07 17:03 I attest to the accuracy and authenticity of this document Chandigarh

CR No. 6986 of 2013 -2counsel submits that the written statement has already been filed by these respondents and he has also got the copy thereof. It is directed that in case the written statement has not been filed by respondents no. 4 to 6, the same be filed in the trial Court on the date fixed before it.

Liberty is also granted to the petitioner to contest the application under Order XXXIX Rules 1 and 2 for grant of temporary injunction which the trial Court would decide expeditiously and in accordance with law.
