Mr. Rajeev Dev Sharma, Advocate for the petitioner. HARSIMRAN SINGH SETHI, J (ORAL) In the present writ petition, prayer made is for release of all the retiral benefits for which the petitioner is entitled for after the death of her husband, who was employed with the respondents-Municipal Corporation, Pathankot.

Learned counsel for the petitioner states that after the death of the husband of the petitioner on 14.12.2017, a sum of Rs.5,17,467/- has been released in her favour but still, payment of gratuity and leave encashment besides certain amount in respect of general provident fund remains to be paid to the petitioner.

Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has served respondents with a representation dated 24.10.2018 (Annexure P-2), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.

CWP No.1981 of 2019 #2# In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the representation dated 24.10.2018 (Annexure P-2) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to her within a period of next three months. Present writ petition stands disposed of.
