-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been for grant of anticipatory bail to the petitioner in FIR No.181 dated 04.09.2019 registered under Sections 323, 354-B, 506 and 34 IPC (Section 307 IPC added later on) at police Station Baroda, District Sonipat.
Learned counsel appearing on behalf of the petitioner would contend that there is an inordinate delay in lodging of the FIR and the injuries that have been suffered are simple in nature. Per contra, learned counsel appearing on behalf of the respondent-State would submit that there is an explanation for the delay in lodging of the instant FIR, as she had been grievously injured by a lathi blow on the head. A DDR had been registered regarding occurrence of the incident on 24.08.2019. It is also submitted that a reading of the medico legal report would reflect that she had been admitted in hospital on 21.08.2019 i.e the day of occurrence and discharged on 03.10.2019. There is an opinion of the doctor available on the record that would reflect that injuries suffered by mother of the complainant were dangerous to life. CRM-M No.3637 of 2020 -2I have heard learned counsel for the parties and have perused the paper book. Keeping in view the fact that the injuries suffered by mother of the complainant were serious in nature and life threatening, this Court is of the opinion that the petitioner is not entitled for grant of anticipatory bail and custodial interrogation would be required. Consequently, the instant petition stands dismissed.
