AMIT RAWAL J. (Oral) The petitioner-defendant is in revision petition seeking rejection of the plaint on account of non-payment of court fee in a suit for damages.

Mr. Ashish Gupta, learned counsel appearing on behalf of the respondents submitted that suit has already reached at the stage of final arguments.

The issue of court fee is kept open and in case, the Court below arrived at some conclusion with regard to determination of damages, the same shall be subject to the payment of court fee. With the aforementioned observations, revision petition is disposed of.
