**** MANJARI NEHRU KAUL, J. (Oral) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 258, dated 24.10.2018, registered under Sections 366, 376, 120-B IPC, registered at Police Station Raman, District Bathinda. Learned State counsel on instructions from ASI Gurpal Singh submits that out of 17 prosecution witnesses cited, only 07 witnesses have been examined till date, which includes material witnesses i.e. the complainant (prosecutrix) and the Doctor. However, keeping in view the seriousness of the offences, learned Sate counsel while opposing the bail application submits that no case for regular bail is made out and prays for dismissal of the instant petition.

Heard.

Having considered the submissions made by either side, the petitioner has been behind bars admittedly since 31.03.2019, and the star witness i.e. the complainant (prosecutrix) has already been examined; further detention of the petitioner will not serve therefore any useful purpose. The petition as such is allowed and the petitioner is admitted to bail to the satisfaction of trial Court/Duty Magistrate. However, it is made clear that anything observed herein shall not be construed as an expression of opinion on the merits of the case.
