An objection to the maintainability of institution of the suit was brought on a plea that after the constitution of a Education Tribunal, the suit could have been instituted only before the Education Tribunal. The Tribunal is constituted only for consideration of disciplinary matters in terms of the judgment of Supreme Court in TMA Pai Foundation and others Vs. State of Karnataka 2002 (8) SCC 481 and it has nothing to do with recoveries of arrears of salary or any other monetary benefit to a person. There is no bar to institution of the civil suit and the objection taken was rightly rejected by the Court below. 2.

I will find no cause for interference. The revision petition is dismissed.
