On 29.01.2024, this Court passed the following order:- "Apprehending his arrest in FIR No. 174 dated 29.09.2021 registered for offences punishable under Sections 376, 511, 458 and 323 IPC at Police Station Shahpur Kandi, District Pathankot; the petitioner has preferred this petition under Section 438 Cr.P.C. seeking pre-arrest bail. Inter alia contends that the petitioner has been falsely implicated on account of a parking dispute; the MLR of the victim was carried out after two days of the incident & the petitioner is willing to join investigation and cooperate therein.

Notice of motion.

On asking of the Court, Mr. Adhiraj Singh Thind, AAG, Punjab, appears and accepts notice on behalf of the respondent-State.

Adjourned to 12.03.2024.

In the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal/surety bond(s) to the satisfaction of the Arresting Officer/Investigating Officer. As and when further called by Investigating Officer, the petitioner shall join the investigation. He shall abide by the condition(s) enumerated under Section 438(2) of the Cr.P.C." 2.

Status report by way of an affidavit of Deputy Superintendent of Police, Sub-Division City, District Pathankot has been filed on behalf of State-respondent, which is taken on record.

On the basis of status report, State counsel submits that the petitioner has joined the investigation and the supplementary report under Section 173 (8), Cr.P.C. is yet to be submitted. 4.

In view of the above development, but without commenting upon the merits of the allegations, petition is allowed. Order dated 29.01.2024 is made absolute, subject to satisfaction of conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
