(Oral) The petitioner was appointed as Extension Lecturer in Physics Department on 09.10.2012 by duly constituted selection committee and her experience certificate is at Annexure P-1. The petitioner is non-NET qualified. As per the judgment passed in CWP- 20767-2017 Anita V/s. State of Haryana and others (P-4) it was observed that non NET qualified candidate could be replaced by NET qualified candidate and the State had taken a decision to pay Rs.25,000/- to all the Extension Lecturer whether they are NET qualified or nonNET qualified. The petitioner has been relieved on 20.07.2018. As per her application dated 30.09.2018 (Annexure P-8), she has stated that the post of Extension Lecturer (Physics) is still lying vacant and she may be allowed to rejoin in the same college.

This Court is of the view that even the post is lying vacant, the prayer of the petitioner can only be considered if the workload is still existing. This petition is being disposed of by giving direction to the respondents to pass appropriate orders on the application dated 30.09.2018 (Annexure P-8), in view of observations made in judgment dated 25.01.2018 (PGaurav Arora 2019.02.05 16:35 I attest to the accuracy and integrity of this document Chandigarh

4) and examine the case of the petitioner for adjustment in nearby college where the workload is available in accordance with law. This exercise shall be completed within a period of one month from the date of receipt of certified copy of this order.
