The instant petition has been filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the petitioner in case FIR No.30 dated 13.06.2018 under Sections 18 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station Special Task Force (Phase-IV), District SAS Nagar, Mohali. 2.
Learned State counsel has brought to the notice of this Court that prosecution evidence stands recorded and the case is now fixed for evidence of the defence, hence, the trial would not take much time to conclude. 3.
Learned counsel for the petitioner has not disputed the status of the trial, however, he submits that the case is being adjourned time and again and in the circumstances, there is no likelihood of the trial concluding in the near future. 4.
Be that as it may, as per instructions received by the learned State counsel and not disputed by learned counsel for the petitioner, the next date of Jaspreet Kaur 2024.01.30 18:47 I attest to the accuracy and integrity of this document Chandigarh
CRM-M-3639-2020 -2hearing before the learned trial Court is 09.02.2024. The petitioner shall surrender before the learned trial Court on the next date i.e. 09.02.2024 since interim order dated 12.02.2020 ceased to be in existence w.e.f. 19.09.2023. In the circumstances, since the trial is nearing conclusion, no ground is made out to extend the concession of regular bail to the petitioner. 5.
The petition stands disposed of in the above terms. 6.
It is made clear that in case the petitioner fails to appear and surrender before the learned trial Court on 09.02.2024, the interim protection granted to the petitioner today, shall cease to be in operation thereafter. 7.
However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case. 8.
