The present revision petition has been filed under Article 227 of the Constitution of India against the order passed by the learned Additional District Judge, Sangrur permitting the plaintiffs to withdraw the suit during the pendency of the first appeal with permission to file a fresh one on the ground that the suit suffers from some formal defects. Learned counsel for the petitioners submits that he would not object to the maintainability of the suit on formal defects. In view of the aforesaid statement, learned counsel for the respondents submits that the impugned order be set aside and the learned first Appellate Court be directed to decide the appeal. Ordered accordingly.
