Maya Ram v. State Of Haryana And Others
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP NO. 2955 OF 2021 DATE OF DECISION : 06.10.2021 Maya Ram
...Petitioner
Versus
State of Haryana and others
...Respondents
CORAM : HON'BLE MR. JUSTICE ARUN MONGA Present :
Mr. Ashsih Gupta, Advocate, for the petitioner.
Ms. Rajni Gupta, Addl. AG, Haryana.
(Presence marked through video conferencing). ARUN MONGA, J. (ORAL) Petition herein, inter-alia, is for issuance of a writ in the nature of mandamus directing the respondents to consider the case of petitioner for appointment on compassionate grounds in place of his deceased father, in view of notification dated 02.08.2019 (Annexure P-4). 2.
Learned counsel for the petitioner submits that father of the petitioner, namely Ajmer Singh, was posted as SCC with the respondentdepartment. He died in harness on 14.01.2002, leaving behind the petitioner, his mother and one brother. Mother of the petitioner had also died on 11.11.2013. It is only after the death of his mother, petitioner came to SHALINI BHATIA 2021.10.13 18:38 I attest to the accuracy and integrity of this document
know that his mother had applied for grant of ex-gratia financial assistance as well as appointment of the petitioner on compassionate grounds. He further argues that a sum of Rs.2,50,000/- was allowed as ex-gratia financial assistance. The petitioner is running from pillar to post to get appointment on compassionate grounds.
3.
On advance service of copy of the petition, learned State counsel joins the proceedings and strongly opposes the issuance of notice of motion on the ground that claim of the petitioner has already been rejected by way of filing reply to the legal notice wherein it has been stated that mother of the petitioner has already received ex-gratia financial assistance to the tune of Rs.2,50,000/- as per the applicable policy at the relevant time and hence, petitioner is not entitled to seek any appointment on compassionate grounds.
4.
I have heard learned counsel for the parties and gone through the case file.
5.
In view of the stand taken by the respondents in their reply to the legal notice, no grounds for interference under extraordinary writ jurisdiction by this Court are made out.
6.
Dismissed.
