(Oral) Learned State counsel has placed on record report by way of affidavit of Deputy Superintendent of Poice, Sub Division, Sultanpur Lodhi supported by death certificate of Jagirt Singh son of Harnam Singh resident of Mohalla Kaimpura, Kapurthala along with supporting documents consisting of FIR and post mortem report regarding accidental death as well as statements of Sukhwinder Singh and Rajinder Singh Dhanjal, MC Mohalla Kaimpura, respectable of the area. In the light of the same it is admitted that the appellant has since died and the appeal abates and becomes infructuous.
