(ORAL) The present revision petition is directed against the impugned order whereby the third party objections of the petitioner, who has allegedly acquired right in the property by virtue of decree dated 16.08.2012 in suit for specific performance of agreement to sell dated 09.06.2005 has been dismissed without framing issues. Mr. Raheja, learned counsel appearing on behalf of respondent No.1 does not object to setting aside of the order, in case this Court directs the trial Court to decide the third party objections after framing issues within a fixed time line.
In view of the aforementioned statement made by counsel for the respondent, the impugned order is set aside. The trial Court is directed to decide the third party objection after framing issues as expeditiously as possible and preferably within a period of one year. The revision petition is disposed of in above terms.
