***** ARCHANA PURI, J. (Oral) On the last date of hearing Mr. Mahender Pal, Advocate had made appearance on behalf of the respondent and he made a statement that he does not intend to file reply and he has no objection if the transfer application is accepted.

Counsel for the applicant heard.

The applicant/wife has filed the present application for seeking transfer of the petition under Section 13 (1) (ia) (ib) of the Hindu Marriage Act i.e. HMA-464-2024 titled "Dheeraj Kansal v/s Lalita Rani", filed by the respondent/husband, which is pending in the Family Courts, Panchkula and she seeks transfer of the same to the court of competent jurisdiction at Yamuna Nagar.

It is submitted by the counsel for the applicant that the marriage between the parties was solemnized on 28.03.2023 and no child was born from the said wedlock. TA-87-2025 residing separate. Even, she has filed the petition under Section 12 of the Protection of Women from Domestic Violence Act and petition under Section 125 Cr.P.C., which are pending in the Courts at Yamunanagar. Also, it is submitted by the counsel for the applicant that the applicant is not working and as such, has no independent source of earning. She is dependent upon her parental family.

Keeping in view the aforesaid mitigating circumstances and in view of the statement made by learned counsel for the respondent, the transfer application is allowed and the petition under Section 13 (1) (ia) (ib) of the Hindu Marriage Act i.e. HMA-464-2024 titled "Dheeraj Kansal v/s Lalita Rani", filed by the respondent/husband, stands transferred from the Family Court, Panchkula, to the Court of competent jurisdiction at Yamuna Nagar. The requisite record of the aforesaid case be sent by the Family Court, Panchkula, to the District and Sessions Judge, Yamuna Nagar. Learned District and Sessions Judge, Yamuna Nagar, shall assign the said petition to the Family Court, Yamuna Nagar.
