**** SANJAY VASHISTH , J. (Oral) Order dated 30.01.2023 says as under:
"This is the petition under Article 226 of the Constitution of India for issuance of directions to official respondents for protection of lives and liberty of petitioners from the hands of private respondents and their other associates and to restrain the private respondents not to harass or interfere in the peaceful married life of the petitioners.
Learned counsel for the petitioners submits that petitioner No.1 - Rupali, aged about 25 years and petitioner No.2 - Brijesh Kumar Pal, aged about 30 years, have solemnized marriage on 23.01.2023, against the wishes of their family members, arrayed as respondents No.6 to 9. He further submits that it is the first marriage of both the petitioners, and private respondents are threatening to interfere in the matrimonial life of the petitioners. Hence, the petitioners are seeking protection in that regard and have approached this Court by way of filing the instant petition. They have also submitted representations dated 23.01.2023 (Annexure P-5) and 24.01.2023 (Annexure P6) wherein, they have expressed their apprehension. 2023:PHHC:045709 CRWP-808-2023 - 2 - Counsel also submits that petitioner No.2-Brijesh Kumar Pal is doing job in a Laboratory, in Sector 12, Chandigarh, for the last 12 years.
Counsel for the petitioners submits that there is confusion in regard to the residence of the petitioners that in which area does it fall i.e. Haryana, Punjab or U.T. Therefore, all the police authorities have been impleaded as respondents in the present petition. Notice of motion.
On advance notice, Mr. Viranjeet Singh Mahal, Addl. PP, UT Chandigarh, appears and accepts notice on behalf of respondent No.5 (UT Chandigarh).
Ld. Addl. PP, UT Chandigarh, points out that the addresses given by the petitioners in the present petition and the address mentioned in marriage certificate is different. As per verification conducted by the Chandigarh Police, petitioners are not resident of the address given in the marriage certificate.
Faced with the situation, counsel for the petitioners submits that let the location of the area, where petitioners are residing be confirmed by the police officials.
Let respondents may file their response.
Counsel for the petitioners submits that at this stage, respondent No.4-Senior Superintendent of Police, SAS Nagar (Mohali), be directed to examine the representation dated 23.01.2023 (Annexure P-5), in case any substance of truth is found, appropriate steps be taken for securing the life and liberty of the petitioners, in accordance with law.
Adjourned to 28.03.2023."
On the very outset, counsel for the petitioners submits that subsequent to filing of the present petition, dispute between the petitioners and private respondents have been resolved amicably, thus, he seeks withdrawal of the present petition.
Dismissed as withdrawn.
