(Oral) In compliance to the order dated 10.11.2022, of this Court, learned State counsel has filed a short reply dated 17.11.2022, by way of an affidavit of Jugal Kishore, HPS, Deputy Superintendent of Police, Fatehabad, District Fatehabad, on behalf of respondent-State in Court today, which is taken on record, subject to all just exceptions. Office to tag the same at appropriate place in case file.
As per details given in para 4 of the short reply, appellant - Vinod Kumar, has already expired on 26.08.2020, due to cancer disease, and in support of the same, a death certificate has also been issued by Municipal Corporation, Hisar. Said death certificate is attached with the status report as Annexure R-1. Paragraph 4 of the status report is reproduced herebelow:- "4.
That in compliance of order dated 10.11.2022, it is respectfully submitted that Investigating Officer visited in Village Hasanga Tehsil and District Fatehabad to verify the life status of Appellant Vinod Kumar son of Prithvi Singh resident of JAWALA RAM 2022.11.22 13:43 I attest to the accuracy and integrity of this document
CRA-S-111-SB-2001 - 2 - village Hasanga Tehsil and District Fatehabad and recorded the statement of Uday Singh son of Maniram resident of village Hasanga Tehsil and District Fatehabad who is Namberdar of the village as well as Uncle of the appellant Vinod Kumar who stated that appellant Vinod Kumar had died on 26.08.2020 due to cancer deceased and he also produced death certificate of appellant Vinod Kumar and as per death certificate issued by Registrar (Birth & Death), Municipal Corporation Hisar, appellant Vinod Kumar had died on 26.08.2020. True copy of death certificate is annexed herewith as Annexure R-1 and copy of the statement of Namberdar/Uncle of appellant Vinod Kumar (since deceased) is annexed herewith as Annexure R-2 for the kind perusal of the Hon'ble High Court.

Keeping in view of the fact that appellant - Vinod Kumar, has already expired, which is also affirmed by learned counsel for the appellant as well as learned State counsel, nothing has left in the present appellant to examine. Hence, present appeal filed by appellant - Vinod Kumar stands abated.
Appeal stands disposed of accordingly.
