Rajinder Kumar @ Rajinder Munim v. State Of Punjab

On 11.03.2026 (in CRM-M-3698-2026) and 27.04.2024, this Court had passed the following orders:- "Petitioner, who is accused in case FIR No.07 dated 05.01.2026 registered against him, for commission of offences punishable under Sections 108, 351(2) of BNS at Police Station Civil Lines Batala, District Gurdaspur, has filed the instant petition, praying for grant of pre-arrest bail. Status report dated 10.03.2026 by way of affidavit of Mr. Sanjeev Kumar, PPS, Deputy Superintendent of Police, Sub-Division City Batala, Police District Batala, has been filed. The same is taken on record. Copy of the same has been supplied to the counsel for the petitioner. In view of the previous detailed order dated 22.01.

2026 passed by this Court and submission advanced by learned counsel for the petitioner, but without expressing any opinion on the merits of the case, the petitioner is hereby directed to join investigation within seven days from today and co-operate in the same. In the event of the arrest of the petitioner, he shall be released on interim bail on his furnishing personal/surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. He shall also abide by conditions as envisaged under Section 482(2) BNSS. Adjourned to 17.04.2026."

27.04.2024 "Learned State Counsel submits that petitioner Rajinder Kumar @ Rajinder Munim did not join the investigation till date in compliance of order dated 11.03.2026 and as regards the other petitioners, they have no orders in their favour to join the investigation. In view of the above, learned counsel for petitioner Rajinder Kumar @ Rajinder Munim prays for one more opportunity to join the investigation in compliance of order dated 11.03.2026; whereas the counsel for the remaining petitioners submit that the allegations against them are similar to that of petitioner Rajinder Kumar @ Rajinder Munim and thus they pray that petitioners namely Komalpreet Singh and G.S. Sandhu be also allowed to join investigation.

In view of the above, the petitioners are directed to join the investigation on 28.04.2026 and cooperate in the same. In the event of the arrest of the petitioners, they shall be released on interim bail on their furnishing personal/surety bonds to the satisfaction of the Arresting/ Investigating Officer. They shall also abide by the conditions as envisaged under Section 482(2) BNSS.

However, it is clarified that if the petitioners do not join or cooperate with the Investigating Agency as required

by the Arresting/Investigating Officer, the interim order shall be deemed to have been vacated.

Learned counsel submit that in pursuance of the aforementioned orders, the petitioners have not only joined investigation but also fully cooperated with the investigating agency. They further submit that in case the investigating agency requires the petitioners to appear, they shall make themselves available without demur. 4.

Learned State counsel on instructions from SI Narjit Singh affirms the factum of joining the investigation by the petitioners and cooperating with the investigating agency. He also submits that at this stage, the petitioners are not required for further custodial interrogation. 5.

In view of the above and without expressing any opinion on the merits of the case, anticipatory bail petitions filed by the petitioners are allowed and the orders dated 11.03.2026 (in CRM-M-3698-2026) and 27.04.2024 6.

However, it is made clear that if the petitioners fail to join and cooperate with the investigating agency as and when required, the State would be at liberty to move an application for cancellation of the present anticipatory bail granted to them.
