Learned counsel for the State has drawn the attention of this Court to the reply filed on behalf of the State and submits that challan in the case has been presented and therefore, the present petition has been rendered infructuous. Learned counsel for petitioners also agrees with the contention raised on behalf of the State and submits that he be permitted to withdraw the present petition with liberty to file a quashing petition on merits. The present petition is disposed of, having been rendered infructuous. However, it is made clear that filing of the present petition shall not come in the way of the petitioner while seeking another remedy.
