(Oral) Present appeal has been preferred against the judgment of conviction and order of sentence dated 16.02.2008 passed by learned Additional Sessions Judge, Fatehabad whereby the appellant was convicted and sentenced for the offence punishable under Section 18(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as 'NDPS Act'), in case stemming from FIR No.93 dated 03.04.2004 registered under Section 18 of NDPS Act at Police Station Sadar Tohana, Fatehabad.
2. Learned counsel for the State, at the very outset, on instructions from SI Om Parkash submits that during the pendency of present appeal, appellant-Rajender Singh has passed away on 04.07.2015 and produced the Death Certificate of the appellant, which is taken on record.
