At the very outset, learned State counsel has informed that the petitioner's uncle stands released pursuant to order dated 24.1.2023. 2.

The aforestated position is admitted to be correct by learned counsel for the petitioner.

Learned State counsel has filed an affidavit of DSP Dewinder Singh, Police Station State Vigilance Bureau, Panchkula, wherein in para No.3, it has been stated that two notices had infact been sent to Ved Prakash through "WhatsApp" before effecting his arrest, which were also responded to by the accused.

Having regard to the fact that the petitioner's uncle already stands released, no further directions are required to be issued. As far as the stand of respondent No.3, regarding issuance of notices through "WhatsApp" is concerned, the validity of service of notice through "WhatsApp" in criminal cases, where question of liberty is also involved, would be debatable and it is expected that such notices are served in person.

The petition, as such, is disposed of.

At this stage, the State counsel has informed that the investigating agency intends to serve a proper written notice to detenue Ved Prakash. Learned counsel representing the petitioner has submitted that he would have no objection for acceptance of such 10 days' advance notice. Needful be done as per law.
