Civil Revision No. 6970 of 2018 (O&M) Date of Decision: December 17, 2018.

V.K.Jain and another ..........PETITIONERS

VERSUS

Naresh Kumar Juneja and others ........RESPONDENTS CORAM:- HON'BLE MR. JUSTICE SURINDER GUPTA

Present:

Mr. H.S. Baidwan, Advocate for the petitioners.

Mr. Divanshu Jain, Advocate for the respondents.

******* SURINDER GUPTA, J.(Oral) Heard.

This is revision against the order dated 18.08.2018 passed by the Rent Controller, Chandigarh allowing application of the respondents/landlord to place on record certified copy of judgments, orders, petition and statements etc. from other petitions. Learned counsel for the petitioners has argued that respondents/ petitioners did not plead that they were not possessing or had vacated any premises in Chandigarh before filing of ejectment petition on ground of personal necessity and now to fill up the lacuna, they intend to place on record these documents.

The submissions of learned counsel for the petitioners makes out no reason to allow this petition, as documents sought to be produced by Jyoti 2018.12.20 10:51 I attest to the accuracy and authenticity of this document

CR-6970-2018 the respondents/landlord relate to the fact of passing of ejectment orders against them. If these documents in any manner help the revision petitioners in their plea, the same could be referred at any time of final arguments. Learned counsel for the respondents has argued that these documents find mention in the amended petition and thereafter affidavits filed by the respondents. However, due to inadvertance certified copies could not be produced on file.

Learned trial Court while allowing the application observed that production of these documents is necessary for proper adjudication of the case. No reason is made out to differ with the observation of learned Rent Controller.

This petition has no merits.

Dismissed.
