**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. Through the instant petition, the petitioner seeks anticipatory bail in case FIR No. 79 dated 30.6.2014, registered under Sections 323, 341, 325, 34 IPC, Police Station Nurpurbedi, District Rupnagar. Learned counsel for the petitioner submits that the petitioner was regularly appearing before the trial Court but remain absented on 15.2.2017 and his bail was cancelled on 23.5.2017 and thereafter he was declared a proclaimed offender on 07.3.2018. He further submits that the earlier counsel for the petitioner has given an impression that a compromise has been effected and there is no need to appear before the Court below. Learned counsel further submits that the co-accused has already stands acquitted.

On the other hand, learned State counsel submits that till date GURPREET SINGH 2021.07.02 16:33 I attest to the accuracy and integrity of this document Chandigarh

CRM-M No. 5970 of 2020 -2neither the petitioner has challenged the proclamation order nor he has appeared before the trial Court and has been absconding for the last 21⁄2 years.

At this stage, learned counsel for the petitioner has restricted his prayer to extent that the petitioner is ready to surrender before the trial Court and the present petition be disposed of with a direction to the trial Court to consider the bail application of the petitioner within a stipulated period.

Keeping in view the above and without commenting on the merits of the case, this petition is disposed of with a direction to the petitioner to surrender before the trial Court within a week from today and move an application for bail and thereafter the trial Court would decide the said application within 10 days.
