Challenge in the present revision petition is to the order dated 04.08.2022 (Annexure P-8), whereby, application under Order 7 Rule 11 CPC filed by the respondents, has been partly allowed. It is submitted by learned counsel for the petitioner that petitioner is ready to make the payment of ad-valorem Court fee, as ordered by the Court below, in the impugned order, but however, the time period granted was only till 26.08.2022 and the said period for payment may be extended.
Further, it is submitted that CR-3365-2022 had been filed by the present petitioner, on an order passed by the Court below, on the application for seeking amendment of the plaint and the same is now pending for 27.04.2023, wherein, it has been ordered that learned Court VINEET GULATI 2023.02.14 10:08 I attest to the accuracy and authenticity of this document Chandigarh
CR-981-2023 -2below shall adjourn the case, beyond the date fixed by this Court. In the given circumstances, it is submitted that further proceedings are not being conducted by the Court below. Considering the aforesaid circumstances, as the petitioner is ready to comply with the direction given by learned Court below for making payment of the ad-valorem Court fee, the time period, as such, is hereby extended. The ad-valorem Court fee be deposited within a period of four weeks from today onwards, before the Court concerned. Accordingly, the present revision petition stands disposed of.
