Moksha v. Diggaj Monga
IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
TA No. 124 of 2019 (O&M) Date of decision : 5.2.2019 ...
Moksha ................Applicant vs.
Diggaj Monga .................Respondent Coram: Hon'ble Mr. Justice H. S. Madaan Present: Mr. Arpandeep Narula, Advocate for the applicant. ...
H. S. Madaan, J. (Oral) Since in terms of Section 9 of the Guardians and Wards Act, 1890, only the District Court having jurisdiction in the place where the minor ordinarily resides, can entertain and try the petition in question, the applicant is relegated to the remedy of approaching the trial Court by moving appropriate application seeking return of the petition for presentation to the Court having territorial jurisdiction in terms of Section 9 of the Guardians and Wards Act, 1890. The trial Court would dispose of such application in accordance with law. If after disposal of the application, the applicant is still aggrieved, then she would be at liberty to approach this Court again.
Disposed of accordingly.
